Terms of Service of molim.xyz


Article 1 (Purpose)
These Terms of Service (the “Terms”) set forth the conditions for use of and all other matters regarding operation of the services provided by molim.xyz (the “Site”).


Article 2 (Definitions)
For the purposes of these Terms, the following definitions shall apply:

  1. Member: A person who has agreed to these Terms, provided personal information to register as a member, and thereby entered into a service-use agreement with the Site.

  2. Service Agreement: The agreement concluded between the Site and a Member regarding use of the Site’s services.

  3. Member ID (hereinafter, “ID”): A unique combination of letters and numbers assigned to each Member for identification and for use of the Site’s services.

  4. Password: A combination of letters and numbers chosen by the Member to verify that the Member correspondingly holds the assigned ID and to protect the Member’s rights.

  5. Operator: The person or entity that opens and operates the homepage of the Site.

  6. Termination: The act by which a Member cancels the Service Agreement.


Article 3 (Matters Not Covered in These Terms)
If the Operator deems it necessary, it may separately post and notify an operational policy. In the event of any conflict between these Terms and the operational policy, the operational policy shall take precedence.


Article 4 (Formation of the Service Agreement)

A Service Agreement is formed when the Operator accepts a person’s application for membership after that person has agreed to these Terms and submitted a membership registration request.

  1. A person who wishes to register as a Member indicates their consent to these Terms by selecting “I agree” during the Site’s sign-up process, after having read these Terms.


Article 5 (Application for Use of Services)

  1. A person who wishes to register as a Member and use the Site’s services must provide all information requested by the Site (e.g., user ID, password, nickname).

  2. If a person registers with false or stolen information, that person shall have no rights related to Site use, and may be subject to penalties under applicable laws.


Article 6 (Privacy Policy)
The Site and the Operator do not retain Members’ passwords submitted at registration; matters related thereto shall be governed by the Site’s Privacy Policy.
The Operator shall endeavor to protect Members’ personal data, including registration information, in accordance with applicable laws.
Members’ privacy shall be protected in accordance with applicable statutes and the Site’s Privacy Policy.
However, the Operator shall bear no liability for any disclosure of Member information caused by the Member’s own fault.
If a Member posts or distributes illegal content—such as content contrary to public order and morals or threatening national security—the Operator may, upon request by relevant authorities, inspect and submit such materials to those authorities.


Article 7 (Operator’s Duties)

  1. If the Operator determines that a Member’s opinion or complaint is justified, the Operator shall promptly address it. If prompt handling is impracticable for personal reasons, the Operator shall do its best to notify the Member later via notice, private message, or email.

  2. To provide continuous and stable service, the Operator shall promptly repair or restore any equipment failure. However, in the event of force majeure or other unavoidable reasons, the Operator may temporarily suspend service.


Article 8 (Member’s Duties)

  1. Members shall comply with these Terms, any regulations set by the Operator, notices, operational policies, and all applicable laws, and shall not engage in any acts that interfere with the Site’s operations or damage its reputation.

  2. Unless expressly authorized by the Site, Members may not transfer, donate, or pledge their service rights or status under the Service Agreement to any third party.

  3. Members shall carefully manage their ID and password, and shall not allow third parties to use them without the Operator’s consent.

  4. Members shall not infringe the intellectual property rights of the Operator, the Site, or any third party.


Article 9 (Service Availability Period)

  1. The Site’s services are, in principle, available 24 hours a day, 365 days a year, except in cases of business or technical impediments. However, the Site may suspend service for regular maintenance, expansion, or replacement at times announced in advance on its homepage.

  2. The Site may also suspend service, without prior notice, in the following cases:

    • Urgent system maintenance, replacement, malfunction, or abnormal operation

    • Force majeure (e.g., national emergencies, power outages, natural disasters)

    • Suspension of telecommunications services by a licensed carrier under the Telecommunications Business Act

    • Overload of service usage preventing normal operation

  3. In cases of suspension under Paragraph 2, the Site shall notify Members by notice in advance whenever possible. If advance notice is impossible due to causes beyond the Site’s control, notice shall be given afterward.


Article 10 (Termination of Service Use)

  1. A Member wishing to terminate the Service Agreement must apply for cancellation online. Termination of use of specific programs provided by the Site is separate from termination of the Service Agreement.

  2. Upon receipt of a termination request, the Site’s related programs will be automatically deleted from the Member management screen, and the Operator will no longer have access to the Member’s information.


Article 11 (Restriction of Service Use)
If a Member engages in any of the following acts, the Site may restrict service use, take legal action, terminate the Service Agreement, or suspend service for a fixed period:

  1. Registering false information at sign-up or thereafter

  2. Interfering with another person’s use of the Site or stealing information

  3. Impersonating the Site’s staff or affiliates

  4. Infringing or interfering with the site’s or others’ rights or operations

  5. Illegally using another Member’s ID

  6. Collecting or disclosing another Member’s personal data without consent

  7. Engaging in conduct objectively deemed criminal

  8. Any other act violating applicable laws


Article 12 (Management of Posts)

  1. The Operator is responsible for monitoring and managing all posts and materials on the Site. If unlawful content is detected or reported, the Operator shall delete it and warn the posting Member. Members are themselves responsible for posts that violate these Terms.

  2. If requested by public authorities such as the Korea Communications Standards Commission, the Operator may, without Member consent, delete or relocate posts.

  3. Unlawful content includes, but is not limited to:

    • Content that insults or defames others

    • Content violating public order or morals

    • Content encouraging illegal reproduction or hacking

    • Commercial advertisements

    • Content objectively recognized as related to crime

    • Infringement of third-party rights

  4. If a third party requests suspension of transmission for defamation or IP infringement, the Site may temporarily suspend transmission and comply with final decisions or agreements received.


Article 13 (Retention of Posts)
If operation of the Site becomes impossible due to unavoidable circumstances, the Operator shall notify Members in advance and endeavor to facilitate transfer of their posts.


Article 14 (Copyright in Posts)

  1. Copyright in posts created by Members belongs to the posting Member. The Site shall not commercially use such posts without consent, except for non-commercial purposes and for display within the service.

  2. Members may not commercially exploit or redistribute information obtained from the Site.

  3. The Operator may delete or refuse registration of content that violates Article 12 without prior notice.


Article 15 (Compensation for Damages)

  1. Members shall be primarily liable for any civil or criminal liabilities arising from their posts.

  2. The Site shall not be liable for damages arising from force majeure or a Member’s willful or negligent acts.


Article 16 (Limitation of Liability)

  1. The Operator shall not be liable for any expected benefits not obtained by Members or damages arising from choice or use of service materials.

  2. The Operator is exempt from liability for service interruptions due to its communications or electricity suppliers.

  3. The Operator shall not be liable for data posted, stored, or transmitted by Members.

  4. The Operator is not liable for service interruptions caused by Members’ fault.

  5. The Operator is not liable for any activities among Members or between Members and third parties.

  6. The Operator shall not guarantee the accuracy or reliability of any content provided.

  7. The Operator shall not be liable for transactions conducted via the service.

  8. The Operator shall not be liable for disputes among Members or between Members and third parties.

  9. The Operator shall not be liable for damages arising from system failures without gross negligence, hacking attacks, or other uncontrollable force majeure.

These Terms shall take effect on April 1, 2022.
